Terms of Service

These Terms of Service govern your use of 5 Star Reach ("Service"), operated by 5 Star Reach ("we," "us," or "our"). By creating an account or using the Service, you agree to these terms.
The Service
5 Star Reach provides automated review request software that sends SMS messages to your customers, routes positive sentiment to your Google Business Profile, and routes negative sentiment to a private feedback form. We operate this service on your behalf using infrastructure and tools we license from third-party providers.
Your Responsibilities
You are responsible for:
- Ensuring you have the right to contact the customers whose information you upload
- Complying with all applicable laws regarding SMS marketing and customer communications, including the TCPA
- Ensuring your use of the Service complies with Google's review policies and terms
- Keeping your account credentials secure
- Providing accurate business and contact information
Subscription and Payment
5 Star Reach is a subscription service billed monthly or annually. Your subscription begins on the date of signup and renews automatically. You may cancel at any time before your next billing date to avoid future charges. Cancellation takes effect at the end of the current billing period.
All payments are processed securely through Stripe. We do not store your credit card information.
30-Day Money-Back Guarantee
If you do not see at least a 30% increase in review volume within your first 30 days of active use, you may request a full refund of your first month's subscription fee. To qualify, you must have actively used the Service by adding customer contacts and sending review requests during the 30-day period. Refund requests must be submitted within 35 days of signup to hello@5starreach.com.
Prohibited Uses
You may not use 5 Star Reach to: send unsolicited messages to individuals who have not consented to receive communications from your business, solicit only positive reviews in violation of Google's policies, submit false or fabricated customer information, or engage in any activity that violates applicable law.
Service Availability
We strive for high availability but do not guarantee uninterrupted service. We are not liable for any losses resulting from service downtime, delays in message delivery, or third-party service failures (including Twilio, Google, or our white-label platform provider).
Limitation of Liability
To the maximum extent permitted by law, 5 Star Reach's total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
Termination
You may cancel your account at any time. We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or abuse the Service. In cases of termination for cause, refunds are not issued.
Changes to These Terms
We may update these Terms from time to time. We will notify active subscribers of material changes by email at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles.
